TERMS & CONDITIONS - Simply scale & grow

1. INTRODUCTION
   This Coaching Agreement ("Agreement") is made between Kerry Metcalfe ("Coach") and the client ("Client"). By signing up for coaching services, the Client agrees to the following terms and conditions.
2. SERVICES PROVIDED
   The Coach agrees to provide business strategy and marketing consultancy services as outlined in the selected coaching package. Services include:

• A structured monthly coaching program with a minimum of 3-month term.
• Ongoing support as outlined in the service details.

3. FEES & PAYMENT TERMS

• The investment for the 1:1 coaching package is £249 per month
• Payments are due in advance on a monthly basis. The recurring payments will be taken on (or around) the date of the first payment made.
• Payments are non-refundable and failure to pay will mean that the program will no longer continue, until overdue payments are made.

4. CANCELLATION & TERMINATION

• The initial 3-month minimum term contract is binding and non-refundable.
• After the initial period, coaching continues on a rolling monthly basis.
• Clients may cancel their rolling monthly coaching with 30 days’ written notice via email to [email protected].
• Kerry Metcalfe reserves the right to terminate the agreement if the Client repeatedly misses sessions or does not adhere to agreed commitments.

5. SESSION SCHEDULING & MISSED APPOINTMENTS

• Coaching calls are scheduled in advance and must be attended on time.
• If the Client needs to reschedule, at least 24 hours’ notice is required.
• Missed sessions without notice may not be rescheduled or refunded.

6. CLIENT RESPONSIBILITIES
   The Client agrees to:

• Show up fully prepared and engaged for each session.
• Implement strategies and take action based on coaching discussions.
• Be open to feedback and willing to make adjustments.
• Maintain confidentiality regarding any proprietary materials provided by the Coach.

7. CONFIDENTIALITY & PRIVACY

• Both parties agree to maintain confidentiality regarding all discussions and materials shared during the coaching relationship.
• The Coach will not disclose Client information without prior consent, except as required by law.

8. RESULTS DISCLAIMER

• The Client understands that coaching is a collaborative process and success depends on their commitment and implementation of strategies.
• The Coach makes no guarantees regarding specific business outcomes, financial results, or growth levels.

9. LIABILITY WAIVER

• The Coach is not responsible for any decisions made by the Client as a result of coaching services.
• The Client acknowledges that coaching does not replace professional legal, financial, or medical advice.

10. AGREEMENT ACCEPTANCE
    By signing up for this coaching program, the Client agrees to these Terms & Conditions.
